Terms
Last updated: [DATE OF PUBLICATION] (draft of 7 October 2026)
These terms apply to the Stream & Rise coaching sessions and to the use of streamandrise.com. By applying, booking or paying for a session, you accept them.
1. Who provides the sessions
Stream & Rise is a programme run jointly by two independent providers. It is not a company, partnership or joint venture, and neither provider is the agent of the other. [VERIFY with partners: no partnership entity.]
- Provider 1: [LEGAL NAME: Byron Baron / BtheMusic!], [ADDRESS], Canada. [Business or tax number, if any.] Runs the session on search, web, YouTube and AI visibility.
- Provider 2: [LEGAL NAME: Camille Jamet], [ADDRESS], France. [SIRET, if any.] Runs the session on streaming, promotion and positioning.
Each tier includes one session with each provider. You enter into a separate contract with each provider for their own session. Each provider is responsible only for their own session.
2. Application and acceptance
Sessions are by application only. Submitting the application form does not create a contract and does not oblige either side. If the programme seems a fit, we invite you to a free 15-minute call. A contract with each provider is formed only when you confirm in writing (email is fine) the tier, fee and dates we propose, and that provider confirms your booking. We may decline an application without giving reasons.
3. Fees, invoices and taxes
- Fees depend on the tier and are set out on the call, then confirmed in writing before booking. They are quoted in euros (EUR).
- Each provider invoices you directly for their own session, so you receive two invoices.
- Taxes are applied according to each provider’s own jurisdiction and status. [LEGAL REVIEW: GST/QST registration for Provider 1; VAT status (e.g. franchise en base) for Provider 2; treatment of clients outside Canada and the EU.]
- Payment terms: [CONFIRM: e.g. payment in full before the session, by bank transfer or card].
4. Scheduling, rescheduling and cancellation
- Both sessions are normally held in the same week, online, in English or French.
- Each session lasts [CONFIRM: 2 hours].
- You can reschedule a session once, free of charge, with at least [CONFIRM: 48 hours] notice.
- Cancellation and refunds: [CONFIRM: notice period and refund rule].
- If a provider has to cancel, they offer a new date or a full refund of their own fee, at your choice.
- If you do not attend without notice, the session is considered delivered. [CONFIRM]
5. Right of withdrawal (consumers in the EU)
If you are a consumer living in the European Union and you book at a distance, you have 14 days from the conclusion of the contract to withdraw, without giving a reason, by writing to the provider concerned. If you expressly ask for a session to take place within that 14-day period, you will owe an amount proportionate to the service provided before you withdraw, and you lose the right of withdrawal once the session has been fully delivered. [LEGAL REVIEW: wording under the French Consumer Code (arts. L221-18, L221-25, L221-28) and withdrawal form; applicability to Provider 1 (Canada) for EU consumers; Quebec Consumer Protection Act rules for distance contracts.]
6. What we promise, and what we cannot
We give you our professional advice and a written plan. We do not guarantee any result: no number of streams, listeners, followers, rankings in Google or any other search engine, mentions in AI answers, playlist placements, bookings or income. These depend on your music, your work after the sessions, and decisions made by platforms and third parties we do not control. We never buy streams, followers or playlist placements.
7. Your responsibilities
- Give accurate information in the application and before the sessions.
- Hold the rights to the music, images and content you share with us, or have permission to share them.
- Keep your account passwords to yourself. We never need them. If we work on a platform with you, we use the access-sharing tools the platform provides.
- Decide what to apply from the plan, and when. You stay responsible for your accounts and your spending.
8. Intellectual property
Session materials (templates, checklists, slides, recordings, written plans) remain the property of the provider who created them. You receive a personal, non-exclusive, non-transferable licence to use them for your own music project. You may not resell or publish them. You keep all rights to your music, your images and your content.
9. Confidentiality
We keep confidential what you tell us about your project, your numbers and your plans, and share it only between the two providers to prepare your sessions. With your written permission only, we may mention you or your results as a reference.
10. Liability
Each provider is liable only for their own session. To the extent the law allows, each provider’s total liability is limited to the fee you paid that provider for the session concerned, and neither provider is liable for indirect losses such as lost income or lost opportunities. Nothing in these terms limits liability that cannot be limited by law, or the rights you have as a consumer. [LEGAL REVIEW: enforceability of the cap under the Quebec CPA and French consumer law.]
11. Governing law and disputes
Byron’s session, and anything Provider 1 invoices, is governed by the laws of Quebec and of Canada applicable there. Camille’s session, and anything Provider 2 invoices, is governed by French law. The mandatory consumer-protection rules of your country of residence still apply where the law says so. Before going to court, write to us at hello@streamandrise.com so we can try to settle the matter. EU consumers may also use a consumer mediator: [LEGAL REVIEW: name of the consumer mediator Provider 2 has joined, as required in France].
12. Language
These terms exist in English and French. For clients in Quebec and in France, the French version prevails. [LEGAL REVIEW]
13. Site publisher and host
- Publishers: Provider 1 and Provider 2, as identified in section 1. Contact: hello@streamandrise.com.
- Publication director: [CONFIRM: name].
- Host: Hostinger International Ltd., 61 Lordou Vironos Street, 6023 Larnaca, Cyprus. [VERIFY]
14. Changes
We may update these terms. The version in force on the day you confirm a booking applies to that booking.
